Personally, I think any loving couple should be afforded the same rights as another, no matter their genitalia. Marriage has changed so much over the centuries- why is it so damn hard for people to accept that it will continue to evolve?

*shakes head* Hold on. Doesn't the first part of that line in the Marriage Act get contradicted by the rest of the Act? If no state need consider a same-sex relationship as a marriage then no state could have legalized marriages between couples of the same sex. Because obviously if another state considers the relationship to be a legally recognized marriage then any state can recognize the relationship as a marriage.

Right?

Legalese is confusing.

Personally I look at it as entering a mutually inclusive partnership rather than a marriage with it's oudated concepts of the man owning or being superior to the woman.

I don't care if a couple is of the same sex or not as long as they treat each other with respect and deference. Then again, I could never understand how a same-sex couple (who can't have kids naturally) could be considered a threat to the institution of marriage (especially with the high divorce rate).

Guess I'm either really weird or really far ahead of my time.

It means that if a couple is married in a state that recognizes same sex marriage (CT) & they move to a state that doesn't (FL), then that state doesn't have to honor the marriage. It prevents those living in PA going to MA to get married then come back to PA & demand to be recognized as married.
And Fed Gov't will not recognize it at all even if all the states allow it

oh lordy. i can't talk about prop 8 any more. it makes my heart hurt. i just wanted to say that the fact that it is 83 degrees in LA and below freezing here makes me miss home oh so very much!

I've done several posts on this topic lately, but as usual, I think you bring a fresh and thoughtful perspective on it. The concept of "civil unions" for all who want them may be gaining some traction. As long as they were defined legally as substantially the same as marriage, AND were recognized across state lines, I think that has possibilities - and could leave "marriage" to the churches who are so anxious to "protect" it.
